When does an accident count against you in Massachusetts?
There are two tests under Massachusetts rules: more than 50% at fault, and a claim payment of more than $1,000 above any deductible. Your insurer tells you and the Merit Rating Board, which adds it to your record. A claim payment up to and including $5,000 is a minor accident, anything above is major, and accidents out of state can count too.
Massachusetts terms from Surchargeable incidents and the SDIP page. Read 8 November 2026.
| Item | What the state says |
|---|---|
| Fault threshold | More than 50% at fault |
| Payment threshold | Over $1,000 above the deductible |
| Minor vs major | Up to $5,000 is minor; over $5,000 is major |
| Experience period | 6 years (Operator SDIP Rating) |
| Major accident points | 4 surcharge points in the state's worked example |
How do you appeal an at-fault finding in Massachusetts?
You go to the Board of Appeal, says the state's appeal FAQ. The hearing is informal, open to the public and lasts about 15 minutes. Your insurer explains why it found you more than 50% at fault, and you offer evidence to overcome the presumption of fault. The decision arrives in 2 to 4 weeks. If it is marked VACATE, the points come off your record.
Insurers may use their own merit rating plans instead of the state plan, per the SDIP page. Compulsory coverages include $25,000/$50,000 bodily injury, personal injury protection up to $8,000 and $30,000 property damage, per the state's auto insurance guide.
