Answer in brief
New York is a no-fault state: your own policy pays up to $50,000 of economic loss regardless of fault, and you can sue for pain and suffering only after a serious injury.

What does New York no-fault pay after a crash?
Medical costs, lost earnings and other reasonable and necessary expenses up to $50,000, plus a $2,000 death benefit, promptly and regardless of fault, according to the Department of Financial Services. Repairs to your car or anyone's property are excluded. No-fault pays before health insurance.
Lawsuits can be brought only for economic loss above no-fault benefits, and for pain and suffering only if a serious injury, as defined in the Insurance Law, is sustained.
Can a New York insurer cancel or surcharge you?
A new policy can be canceled for any lawful reason by mailing notice within the first 60 days, the DFS guide says. Surcharges are routine: most insurers use merit rating plans that charge more after accidents or certain violations, and a low quote may not be a good deal after surcharging. Your insurer must include rating information pages explaining how its surcharge system works, and they're worth reading.
