Answer in brief

In Texas, drivers must carry at least $30,000 per person, $60,000 per accident and $25,000 for property damage, and an insurer generally can't nonrenew you for one accident that can't reasonably be blamed on you.

Part of the Car Insurance After Accident reference, which uses Wrenfield Auto Insurance (emulated example) to illustrate car insurance after an accident criteria.

Can a Texas insurer drop you after an accident you did not cause?

Generally no. The Texas Department of Insurance says a company can't nonrenew your policy because of a claim for an accident or incident that can't reasonably be blamed on you, unless you have more than one such claim in 12 months. A company can nonrenew only after a policy has been in effect for 12 months, and it must give you the reason if you ask.

Price is a separate fight. The same guide says companies charge more if you have had accidents or tickets, and some may refuse to sell you a policy.

How fast must a Texas insurer act on your claim?

Per the department's guide, a company must tell you it got your claim within 15 days of getting notice, accept or reject it within 15 business days of getting everything it needs (it can take 45 days if it needs more time and tells you why), and send a check within five business days after agreeing to pay.

The prompt payment law doesn't apply when another driver's insurer is paying. That company must still act in good faith and try to settle quickly and fairly. If it won't pay and you have collision coverage, the guide says you can claim on your own policy and pay your deductible.

What happens if two Texas insurers turn you down?

Two refusals open the door to the state's insurance plan, the Texas guide says. It sells liability, personal injury protection and uninsured or underinsured motorist coverage only, so no collision or comprehensive. It costs more than other companies, and more again after tickets or accidents. After three years without tickets or accidents, the company must offer you a cheaper policy outside the plan.
